Die Arbeit untersucht eine Auswahl der beim Kulturgüteraustausch auftretenden Rechtsprobleme. Ausgehend von der Qualifizierung der Vereinbarungen beim Kulturgüteraustausch als Leihverträge folgt eine Untersuchung der Rechte und Pflichten der beteiligten Parteien. Weiterhin wird im Rahmen dinglicher Rechtsprobleme auf die Bösgläubigkeit beim Erwerb von Kulturgütern eingegangen. In diesem Zusammenhang wird u. a. auch das britische «International Art & Antique Loss Register Ltd.» näher erörtert. Es folgen Ausführungen zu den rechtlichen Schwierigkeiten, die bei der Versteigerung und der Ersitzung von Kulturgütern auftreten können. Den Abschluß der Studie bildet eine Untersuchung spezieller versicherungsrechtlicher Probleme, wobei auch auf das sog. «Art-Napping» eingegangen wird.
