Focusing on trial in absentia within International Criminal Tribunals, this thesis presents a normative framework that integrates classical international criminal law sources with procedural theory and fundamental rights. It critically examines existing models and proposes a novel concept that balances the defendant's right and obligation to be present during trials. This approach aims to enhance the fairness and legitimacy of absentia proceedings in the context of international justice.
