Focusing on the EU's role in WTO Dispute Settlement Proceedings, this work critiques the flawed concept of joint membership between the EU and its Member States, which risks implicating the EU in violations by its members. It explores the complexities of power distribution within the EU and proposes a model for participation in these proceedings based on public international law and EU constitutional principles. The analysis aims to clarify responsibility in mixed agreements, advocating for a solution that reassigns accountability without necessitating a declaration of powers.
