"Freedom within the press" and "Tendency protection" under Art. 10 of the European Convention on Human Rights

Article 10 of the European Convention on Human Rights safeguards freedom of expression and information, including press freedom at the European level. Recently, there have been calls, particularly from the EC and the Council of Europe, to legally establish a "freedom within the press" to enhance and formalize the editorial autonomy of journalists and editors. This initiative faces a conflict with the rights of media owners to dictate the content and political perspectives presented by their enterprises. A significant aspect of this issue is the "tendency protection," which allows media owners to maintain control over editorial decisions, limiting the co-determination rights typically afforded to employees in other sectors. This volume explores whether the push for a freedom within the press aligns with Article 10 of the European Convention on Human Rights, focusing on the guarantees and implications of European media freedom for companies. This publication serves as an English summary of the work titled "'Innere Pressefreiheit' und Tendenzschutz im Lichte des Art. 10 der Europäischen Konvention zum Schutze der Menschenrechte und Grundfreiheiten," published in 1996 in "Schriften zum europäischen Recht," vol. 27.
